Diddy’s lawyers claim his rights were violated with the jail cell search

Sean “Diddy” Combs’ Legal team claims a recent search of the music mogul’s jail cell violated his right to attorney-client privilege.

Diddy, 55, is currently incarcerated in Brooklyn’s Metropolitan Detention Center while awaiting trial on federal sex-trafficking charges. Days after prosecutors alleged in a legal motion Friday, Nov. 15, that Diddy tried to obstruct an investigation by contacting witnesses while in jail, Diddy’s lawyers fired back.

“Defense counsel recently learned that prosecutors are in possession of attorney-client privileged material, including the defendant’s own written notes. This search and seizure violates Mr. Combs’ Fourth, Fifth, and Sixth Amendment rights,” lead attorney Marc Agnifilo argued in a letter submitted on Monday, November 18.

In court documents obtained by Us Weeklyasked Agnifilo Justice Arun Subramanian to an “immediate evidentiary hearing” to examine the search, which he called a “targeted seizure” amounting to a “substantial violation of due process.” He requested that it be determined “who authorized a search of Mr. Combs’ sleeping area, personal belongings and paperwork” and “who determined what paperwork” was turned over to the United States Attorney’s Office.

Agnfilo further claimed that Diddy’s legal team was unaware that the musician’s written notes were taken from his cell and given to prosecutors until prosecutors filed a motion on Friday to charge Diddy with trying to influence the outcome of his trial. Citing a review of recorded calls by Diddy in Friday’s legal filing, prosecutors alleged the rapper made “hundreds” of calls and texts in violation of prison rules, using phone accounts belonging to other inmates.

“Since the defendant has been detained at MDC, he has continued to attempt to evade law enforcement surveillance, corruptly influence testimony and further attack the integrity of these trials,” the court documents obtained by CNN read. “While attempting to evade law enforcement surveillance, the defendant has, among other things, orchestrated social media campaigns aimed, in his own words, at tainting the jury pool; made an effort to publicly leak materials he sees as useful to his cause; and contacted witnesses through third parties.”

Diddy was arrested and charged with sex trafficking, extortion, conspiracy and transportation to engage in prostitution in September. A 14-page indictment accused him of hosting “elaborate and manufactured sex shows” called “Freak Offs” and alleged that he used “force, threats of force and coercion to induce victims to engage in prolonged sex acts with male commercial sex workers.”

Diddy pleaded not guilty and has denied the charges against him. He has since been refused bail three times. The prosecution made its latest allegations of Diddy’s attempt to “corruptly influence” the outcome of his trial as he argued for his fourth bail application to be denied.

Diddy and his legal team proposed the new $50 million bail package earlier this month, arguing that he should be allowed to prepare for his May 2025 trial outside prison due to changed circumstances and new evidence. The filing proposed a “far more robust” bail package, with house arrest, round-the-clock security monitoring and restrictions on Diddy’s ability to contact anyone other than his legal team. No decision has yet been made on the fourth bail attempt.
